TSHISEKEDI IN THE WAY OF BEING ARRESTED FOLLOWING ROSE MUTOMBO’S CIRCULAR RELATING TO THE LIFTING OF THE MORATORIUM ON THE DEATH PENALTY IN THE DEMOCRATIC REPUBLIC OF CONGO. HE IS STRICT BY ARTICLES 157 AND 158, 181 to 184 AND 202, 204 AND 208 OF THE PENAL CODE BOOK II. 

- The articles mentioned above incriminate FÉLIX TSHISEKEDI of association of criminals, treason, participation in armed gangs and participation in an insurrectional movement. 

- ⁠Indeed, Mr. TSHISEKEDI is guilty of having entered into a secret agreement with the M23 long before he took office as president in January 2019 (Reports of the United Nations group of experts on the Democratic Republic of Congo 2021, 2022 and 2023). 

- ⁠Under Etienne Tshisekedi Wa Mulumba, the UDPS had made contact with the M23 and a delegation was sent to Rwanda to do this in 2012 (Cfr United Nations Group of Experts Report). 

- ⁠The CASE expects the Prosecutor General at the Court of Cassation to declare the death penalty against Mr. FÉLIX TSHISEKEDI and AUGUSTIN KABUYA in his capacity as Secretary General of the UDPS.
